1. Introduction

Elektronic Group (“we,” “our,” or “us”) respects your privacy. This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and the choices and rights you have over it.

This Policy applies to elektronicgroup.com, our online store, our customer support channels, our email and marketing communications, and any other service that links to this Policy (collectively, the “Services”). It does not apply to third-party websites or services we do not control, even if you reach them through a link on our site.

If you do not agree with this Policy, please do not use the Services.

2. Summary

The short version, with pointers to the details:

  • We collect what you give us (account and order details), what your device tells us (IP address, browser, usage), and what we receive from partners such as payment processors and advertising platforms. See Section 3.
  • We use it to run your account, fulfill orders, provide support, secure the Services, and market to you. See Section 4.
  • We use cookies and similar technologies, including for advertising. You can control these. See Section 5.
  • We share information with service providers, advertising partners, and others in the limited circumstances described in Section 6.
  • We disclose personal information to advertising partners in ways that qualify as “selling” or “sharing” under some state privacy laws. You can opt out. See Section 7.
  • Depending on where you live, you may have rights to access, correct, delete, or port your information, and to opt out of certain uses. See Section 10.

3. Information We Collect

3.1 Information you provide to us

  • Account and profile information. Name, email address, password, phone number, and any optional profile details you add.
  • Order and transaction information. Billing address, shipping address, items purchased, order history, returns and exchanges, and gift recipient details you supply.
  • Payment information. Payment card details are collected and processed by our payment processors. We receive only limited information such as the card brand, the last four digits, the expiration date, and the authorization result. We do not store full payment card numbers on our systems.
  • Communications. The contents of emails, chat sessions, support tickets, and phone calls with our team, including any attachments. We may record or transcribe support calls where permitted by law and where we have given you notice.
  • User-generated content. Product reviews, message board posts, community comments, photos, and anything else you choose to post publicly through the Services. Assume this content is visible to others.
  • Marketing and event information. Information you provide when you subscribe to our newsletter, enter a contest or giveaway, respond to a survey, or register for an event.

3.2 Information we collect automatically

  • Device and connection data. IP address, browser type and version, operating system, device identifiers, device model and manufacturer, screen resolution, language settings, and referring and exit URLs.
  • Usage data. Pages and products viewed, search terms entered on our site, links clicked, time spent on pages, access times and dates, cart activity, and crash or error logs.
  • Approximate location. We infer approximate location (typically city or region) from your IP address. We do not collect precise geolocation from your device unless you grant us permission, and you can withdraw that permission in your device settings at any time.
  • Cookies and similar technologies. See Section 5.

3.3 Information we receive from others

  • Payment processors and fraud prevention providers, including transaction outcomes and risk signals.
  • Shipping and logistics providers, including delivery status and address validation results.
  • Advertising and analytics platforms, including measurement data and, where lawful, audience segments.
  • Social media platforms, if you connect an account or interact with us there. What we receive depends on your settings on that platform, which you control.
  • Business partners and co-marketing partners, where you have engaged with a joint promotion.

3.4 Sensitive information

We do not seek to collect sensitive personal information such as government identification numbers, precise geolocation, biometric data, racial or ethnic origin, religious beliefs, health information, or information about sexual orientation. Please do not send us this information. If you provide it voluntarily, for example in a support message, we will use it only as necessary to respond to you and will delete it when it is no longer needed.

4. How We Use Your Information

We use personal information to:

  • Create, maintain, and secure your account.
  • Process orders, payments, shipments, returns, refunds, and exchanges.
  • Provide customer support and respond to your questions.
  • Send transactional messages such as order confirmations, shipping notices, receipts, and security alerts. You cannot opt out of these while you have an active account or order, because they are part of the service.
  • Send marketing communications, including newsletters and product announcements, where permitted by law or where you have consented. You can unsubscribe at any time.
  • Personalize the Services, including product recommendations and content relevant to your interests.
  • Run and administer contests, giveaways, surveys, and events.
  • Enable user-to-user features such as reviews and message boards.
  • Measure and improve the Services, including analyzing usage patterns and testing new features.
  • Detect, investigate, and prevent fraud, abuse, security incidents, and other unlawful activity.
  • Enforce our terms and policies, resolve disputes, and establish or defend legal claims.
  • Comply with legal obligations, including tax, accounting, and consumer protection requirements.

We do not use your personal information to make decisions that produce legal or similarly significant effects about you without human involvement.

4.1 Legal bases (EEA, UK, and Switzerland)

If you are in the European Economic Area, the United Kingdom, or Switzerland, we process personal information on the following legal bases:

  • Performance of a contract, to create your account, fulfill your orders, and provide support.
  • Legitimate interests, to secure and improve the Services, prevent fraud, understand how our Services are used, and market to existing customers. We balance these interests against your rights, and you may object as described in Section 10.
  • Consent, for non-essential cookies, certain marketing communications, and any optional feature that asks for your permission. You can withdraw consent at any time without affecting processing that already took place.
  • Legal obligation, to meet tax, accounting, and other regulatory requirements.

5. Cookies and Similar Technologies

We and our partners use cookies, pixels, tags, SDKs, and local storage to operate the Services and to understand how they are used. We use four categories:

  • Strictly necessary. Required for the site to function, including signing in, keeping items in your cart, load balancing, and security. These cannot be turned off through our cookie tool.
  • Functional. Remember your preferences, such as language and region.
  • Analytics. Help us understand traffic and usage so we can improve the Services.
  • Advertising. Deliver and measure ads on our site and on other sites, and build audiences for marketing.

You can manage non-essential cookies through our cookie preference tool, available in the footer of every page. You can also block or delete cookies through your browser settings, though parts of the Services may not work correctly if you do.

Global Privacy Control. We honor the Global Privacy Control (GPC) signal. When we detect a GPC signal from your browser, we treat it as a request to opt out of the sale and sharing of personal information and of targeted advertising for that browser. Because the signal is tied to a browser rather than to you, you will need to enable it on each browser and device you use. We do not respond to other Do Not Track signals, as there is no common industry standard for them.

6. How We Share Your Information

We do not sell your personal information for money. We share it in the following circumstances:

  • Service providers. Companies that perform services on our behalf, including payment processing, fraud prevention, order fulfillment and shipping, cloud hosting, customer support tooling, email delivery, analytics, and marketing operations. They are contractually restricted to using the information only to provide services to us.
  • Advertising and marketing partners. Platforms that help us deliver and measure advertising. Some of these disclosures qualify as “selling” or “sharing” under state privacy laws. See Section 7.
  • Corporate affiliates. Our parent company and subsidiaries, which are required to handle the information consistently with this Policy.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, including during due diligence. We will notify you if your information becomes subject to a materially different privacy policy as a result.
  • Legal and safety. When we believe disclosure is required by law or legal process, or is reasonably necessary to investigate suspected fraud or violations of our terms, or to protect the rights, property, or safety of Elektronic Group, our customers, or the public. Where we are legally permitted to do so, we will attempt to notify you of a government or third-party request for your information before responding.
  • With your direction. When you ask us to share information, such as connecting a third-party account.
  • Aggregated or de-identified data. We may create and share data that cannot reasonably be used to identify you. We maintain such data in de-identified form and will not attempt to re-identify it, except to test that our de-identification process works.

We do not share your personal information with investors or other third parties for their own independent marketing purposes.

7. Selling, Sharing, and Targeted Advertising

Some U.S. state privacy laws define “sell” and “share” broadly. Under those definitions, our use of advertising cookies and similar technologies may qualify as selling or sharing personal information, and as processing for targeted advertising, because it allows partners to receive identifiers, device information, and browsing activity. The categories involved are identifiers, internet and network activity, commercial information such as purchase history, and inferences drawn from that information.

You can opt out at any time by:

  • Using the “Do Not Sell or Share My Personal Information” link in the footer of our site.
  • Adjusting your choices in our cookie preference tool.
  • Enabling Global Privacy Control in your browser.

We do not knowingly sell or share the personal information of consumers under 16 years of age.

8. Data Retention

We keep personal information only as long as we need it for the purposes described in this Policy, and then delete it or de-identify it. In practice:

  • Account information is retained while your account is active and for a limited period afterward so you can reactivate it. If your account is inactive for an extended period, we may close and delete it after notifying you.
  • Order and transaction records are retained for the period required by tax, accounting, and consumer protection law, which is generally several years from the date of the transaction.
  • Support communications are retained for a limited period after the matter is resolved, so we can handle follow-up questions and quality assurance.
  • Marketing data is retained until you unsubscribe or opt out, plus a short period to honor and record your request.
  • Suppression lists, meaning the records that tell us not to contact you, are kept indefinitely, because deleting them would cause us to contact you again.
  • Server logs and security data are retained for a short period unless needed for an ongoing investigation.

Where we are required to retain information to comply with a legal obligation or to establish or defend a legal claim, we keep it for as long as that obligation or claim requires.

9. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and regular review of our practices. We require our service providers to maintain appropriate safeguards as well.

No system is perfectly secure, and we cannot guarantee that unauthorized parties will never defeat our safeguards. You can help by using a strong, unique password, enabling any available account security features, and notifying us promptly at info@elektronicgroup.com if you believe your account has been compromised.

If we become aware of a breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law.

10. Your Privacy Rights

The rights available to you depend on where you live. We do not discriminate against you for exercising any of them. You will receive the same quality of service and the same prices.

10.1 Everyone

Regardless of where you live, you can:

  • Access and update your account information through your account settings.
  • Unsubscribe from marketing email using the link in any marketing message, or by contacting us.
  • Manage cookie preferences through our cookie tool.
  • Ask us to delete your account by contacting us.

10.2 U.S. state privacy rights

If you are a resident of a state with a comprehensive privacy law, including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as they take effect, you may have the right to:

  • Know and access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclose it to.
  • Correct inaccurate personal information.
  • Delete personal information we hold about you, subject to legal exceptions.
  • Obtain a portable copy of information you provided to us.
  • Opt out of the sale or sharing of personal information, targeted advertising, and profiling that produces legally significant effects.
  • Limit the use of sensitive personal information, where applicable.
  • Appeal a decision we make about your request. If we decline your request, our response will explain how to appeal.

California residents may also request the specific pieces of personal information we hold, and under California’s “Shine the Light” law may request information about disclosures to third parties for their direct marketing purposes.

Florida residents: the Florida Digital Bill of Rights applies only to businesses above a revenue threshold that we do not currently meet. We nonetheless extend the rights described above to Florida residents as a matter of policy.

Authorized agents may submit requests on your behalf with proof of authorization. We may ask you to verify directly that you granted the agent permission.

10.3 EEA, UK, and Swiss rights

If you are in the EEA, the UK, or Switzerland, you have the right to access, correct, delete, restrict, and port your personal information; to object to processing based on legitimate interests, including direct marketing; and to withdraw consent at any time.

You also have the right to lodge a complaint with your local supervisory authority. In the UK, that is the Information Commissioner’s Office. We would appreciate the chance to address your concern first.

10.4 How to submit a request

Email info@elektronicgroup.com with the subject line “Privacy Request.”

To protect your information, we will verify your identity before acting, usually by confirming details already associated with your account, or by asking you to respond from the email address on file. We do not require you to create an account to submit a request.

We will respond within the time required by applicable law, generally 45 days in the United States and one month in the EEA and UK. We may extend this period where the law permits, and we will tell you if we do.

11. International Transfers

We are based in the United States, and the personal information we collect is processed and stored in the United States and in other countries where our service providers operate. Privacy laws in those countries may differ from the laws where you live.

Where we transfer personal information out of the EEA, the UK, or Switzerland, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, together with supplementary measures where necessary. You may request a copy of the relevant safeguards by contacting us.

12. Children’s Privacy

The Services are intended for adults. We do not knowingly collect personal information from children under 13, and we do not direct the Services to them. If you believe a child under 13 has provided us personal information, contact us at info@elektronicgroup.com and we will delete it promptly.

As noted in Section 7, we do not knowingly sell or share the personal information of consumers under 16.

13. Third-Party Links and Services

The Services may link to or embed content from third parties, including payment providers, social media platforms, and advertising partners. Those parties collect information under their own privacy policies, which we encourage you to read. We are not responsible for their practices.

14. Changes to This Policy

We may update this Policy to reflect changes in our practices or for operational, legal, or regulatory reasons. When we do, we will update the “Last updated” date above. If the changes are material, we will provide additional notice before the changes take effect, for example by email or by a prominent notice on the Services, and we will obtain your consent where the law requires it.

Prior versions of this Policy are available on request.
